International / Trademarks / Co-existence in Cyberspace
In the Journal of World Intellectual Property, Vol 3, No 2 (March, 2000), Annette Kur, senior researcher at the Max Planck Institute, tackles the question of Identical Marks belonging to different Owners in different Countries and How they can exist in Cyberspace. The author points out that exposure of Internet material, including trademarks, is world-wide and that this is directly opposed to the fundamental principle of territoriality in intellectual property law. In the context of the Hague Conference on Private International Law, the author discusses the future of extra-territorial jurisdiction in Internet infringement cases and puts forward her own proposals on, among other things, the choice of venue.[20004]
