In the Journal of Intellectual Property Law, Vol 7 No 1, published by the University of Georgia School of Law, Professor Shubba Ghosh, writing on Gray Markets in Cyberspace, provides an interesting analysis from an economic as well as a legal point of view of the meaning of gray markets and the legal models for dealing with the problem of "unauthorized distribution" in cyberspace. The models discussed in the article include the copyright and trademark approaches, the contract and property approaches and the sui generis approach. The author concludes that "once gray marketing is accepted as the appropriate conceptual model for understanding the distribution of information in cyberspace, a strong legal conclusion emerges: information in cyberspace should be protected by a regime of weak property rights and strong protection of public use".
